CDC/HHS Quarantine Amendment – ALL HANDS ON DECK

RE: Proposed CDC/HHS Amended Quarantine Policy
Deadline: Midnight October 14, 2016 

On August 15, 2016, the US Center for Disease Control, (CDC), and the Human Health Services, (HHS), issued a Notice for Proposed Rulemaking, NPRM, an amendment to its domestic and foreign quarantine policy. The deadline to receive public comments is October 14, two weeks before the vote for the next US President. It is a scary and drastic amendment, one which will remove Health and Medical Freedom from United States citizens and others traveling domestically or to/from the US via plane or boat. If this amendment is approved, travelling with a noticeable sniffle, cough, sneeze or sore throat may lead to serious implications.  While this proposal currently pertains to boat and plane travel, if this amendment becomes effective, the chances are high that this will spread to other modes of transportation. We will lose rights to our health freedom.

The 88-page Proposed Rule amendment gives a health services official the authority to apprehend, examine, detain, and take medical actions – vaccinations are included in and referred to at the end of the document –  anyone suspected of being a carrier of a communicable disease. Measles is focused on along with Ebola, MERS, and Tuberculosis.  Upon closer inspection of the Proposed Rule document, other diseases – Pertussis, Rubella, Rabies, Viral Hemorrhagic Fevers, Meningoccal disease are being considered in this amendment.  The amendment states, “..Although each instance is unique, an apprehension will typically occur at the request of a state or local health department or in other time-sensitive situations, such as at a U.S. port of entry, where it is necessary for HHS/CDC to take immediate action to protect public health .. ”  

Here’s what could happen:
You’re on a plane, flying home from a trip, you begin sneezing, your partner/friend begins coughing and your steward or stewardess notices. Upon landing, as you’re getting off the plane, someone calls your name over the loudspeaker and asks you to meet them at baggage claim. When you get to the baggage claim, an official is waiting and asks you and your partner to step into the next room where you and your partner/friend are apprehended.

This is what would be legal for a Health services official to do:

1. Apprehend – as defined in the amendment – Apprehension means the temporary taking into custody of an individual or group for purposes of determining whether quarantine, isolation, or conditional release is warranted,
2. Examination of anyone believed to be infected and contagious with a communicable disease.
3. Detained – from 20 minutes, to 1-2 hours or 24 hours – 48 hours, if need and forcibly vaccinate any individual who is perceived as a potential carrier of a communicable disease.
4. Conditional Release – public health supervision through in-person visits by a public health official (or designee), telephone, or through electronic or internet-based monitoring as that term is defined. In general, such monitoring may include electronic or internet-based systems, such as video chat and voice calls from computers, tablets and mobile devices. This language is intended to be broad and would apply to any new or existing technologies that would allow for the public health supervision and monitoring of an individual under a conditional release order.
5. Agreements – CDC may enter into an agreement with an individual, upon such terms as the CDC considers to be reasonably necessary, indicating that the individual consents to any of the public health measures authorized under this part, including quarantine, isolation, conditional release, medical examination, hospitalization, vaccination, and treatment; provided that the individual’s consent shall not be considered as a prerequisite to any exercise of any authority under this part.

CALL  TO ACTION – Here’s what you can do.

3. Call the CDC and ask for an extension regarding COMMENTS
   Call (404) 498 1600.  Let the operator know that you are calling to request an extension on docket number, CDC 2016 0068. You will be asked for your name, email and phone number. This will begin a process of being connected with various people. You must remember to reference docket number, CDC, 2016 0068. This request will become an “Escalation Request.”
   
4. Call and email your Congress member. (find contact info at http://www.house.gov/representatives/find/) Request that they stop the CDC’s proposal from being enacted. Then ask YOUR Congress member to request THEY contact the Energy and Commerce Committee Members (https://energycommerce.house.gov/about-ec/energy-commerce-committee-members) on your behalf,. The Energy and Commerce Committee is CDC’s Oversight Committee. Congress, through the Congressional Review Act (CRA) (5 U.S.C. Chapter 8), may review and choose to reject new regulations issued by Federal agencies. The CRA requires Federal agencies to submit all new final rules to both the House and Senate. After submission, Congress may begin a process to reconsider and vote to overturn the rule. Most legislators are probably not even aware of the proposed regulation. (Credit: AVFC)
